HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL MISCELLANEOUS APPEAL No.4782 of 2004 JUDGMENT : (per Hon'ble Sri Justice R.Subhash Reddy) This appeal, under Section 19 of the Family Courts Act, 1984 is filed by the appellant-husband aggrieved by the order and decree dated 15.10.2004 in O.P.No.193 of 2003 passed by the Family Court, Secunderabad, dismissing the petition filed by him under Section 10 (1)(x) of the Divorce Act seeking to dissolve the marriage between the parties.

2. It is to be noticed that the age of the appellant in the year 2004 itself is 68 years. Now, the appellant must be aged about 79 years. Though the appeal is of the year 2004, when the matter is called, there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.

3. Accordingly, this appeal is dismissed for nonprosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs. ____________________________ JUSTICE R. SUBHASH REDDY ___________________________________ Dr. JUSTICE B.SIVA SANKARA RAO 28.01.2015.
