THE HON'BLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION No. 8899 OF 2022 O R D E R:

This Petition has been filed by the petitioner/1st accused under Sections 437 and 439 of Cr.P.C., in Crime No. 528 of 2022 of Kukatpally, Police Station on the file of XII Additional Junior Civil Judge-cum-XII Additional Metropolitan Magistrate, Medchal Malkajgiri District at Kukatpally registered for the offence punishable under Section 364-A of Indian Penal Code.

The case of the prosecution in brief is that the victim had been kidnapped for ransom by the accused. 3.

The learned counsel for the petitioner would submit that even as per the remand report, the victim was dropped back on 15.07.2022 at 11.00 A.M., and the material part of investigation has been completed by the investigating agency. That apart, the petitioner is in judicial custody for more than 90 days. Hence prayed for granting bail.

Learned Assistant Public Prosecutor opposed the application and would submit that the investigation is still pending. On enquiry, he submits that the statement of victim has already been recorded.

Perused the petition and the materials on record. 6.

Having regard to the stage of the investigation and duration of judicial custody undergone by the petitioner and other circumstances of the case, I am inclined to grant bail to the petitioner.

Resultantly, the petitioner/1st accused is granted bail, subject to his execution of self bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of XII Additional Junior Civil Judge-cum-XII Additional Metropolitan Magistrate, Medchal Malkajgiri District at Kukatpally. The petitioner shall make himself available as and when required by the investigating officer for the purpose of investigation till filing of the final report.

The petitioner shall not influence or intimidate or attempt to tamper the prosecution witnesses or evidence.
