HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 4529 of 2009 Order:
This Writ Petition was filed challenging the order of appointment of the fourth respondent as Anganwadi worker for Anganwadi center at Aravallipadu village, Prakasam district.
It is the case of the petitioner that after notification for the vacancy of Anganwadi worker at Anganwadi center, Aravallipadu village, she applied for the said post. She appeared for the interview on 30.09.2008. She was not communicated anything and when she came to know that the fourth respondent was appointed, she filed the present Writ Petition challenging her appointment on the ground that the fourth respondent was married to one Sudhakar who is a permanent resident of Thurpu Chowtapalem village of Darsi Mandal. She also stated that she passed 10th Class in first division, whereas the fourth respondent is not a meritorious candidate.
Now a counter affidavit is filed stating that the fourth respondent submitted a residence certificate issued by the Mandal Revenue Officer, Donakonda Mandal stating that she is resident of Aravallipadu village and she also produced a Ration Card with her name and her husband's name. Further, it is stated that the fourth respondent secured 43 marks, whereas the petitioner secured 31 marks in the interview. In view of the above facts, this Court sees no ground to interfere with the order of appointment of the fourth respondent and the Writ Petition is, accordingly, dismissed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
