HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4759 OF 2009 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the respondents 1 and 2 in interfering with the poultry shed construction and feed plant/godowns being made in the land of the petitioner in Survey Nos.541/6 and 542/ situated at Gundramapally Village, Chityala Mandal, Nalgonda District, as arbitrary and illegal and for a consequential direction to the respondents not to interfere with the said work.
This Court on 06.03.2009, while admitting the writ petition granted interim order directing the respondents not to interfere with the construction that is being undertaken by the petitioner, if there exists valid permission from the Gram Panchayat, pending further orders.
Learned counsel for the petitioner submits that by virtue of the interim order dated 06.03.2009, entire construction has been completed. Learned Standing counsel appearing for the Gram Panchayat seeks time for getting instructions.
Since the construction is already completed, nothing survives for adjudication in the writ petition. But, however it is open for the respondent Gram Panchayat to take action on the petitioner if he has committed any irregularities in violation of the permission granted to him, by following due process of law. With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
