HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 11112 of 2001 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not regularizing the services of the petitioners and paying the time scale of pay to them, as illegal and arbitrary. A consequential direction is also sought to the respondents to regularize the services of the petitioners and pay the minimum time scale of pay with all attendant benefits along with arrears to them.

When the matter is taken up for hearing, it is brought to the notice of this Court by the standing counsel for the 1st respondent University that petitioner Nos.2 to 5 are not working with the 1st respondent University. It is also brought to the notice of this Court that the 1st petitioner herein along with others filed W.P.No.7614 of 2018 against the respondents herein seeking same relief as sought for in the present writ petition and this Court, vide orders dated 08.03.2018 in I.A.No.1 of 2018 in W.P.No.7614 of 2018, directed the 2nd respondent therein to consider the representations of the petitioners therein dated 30.10.2017 within eight weeks and communicate its decision to the petitioners therein, pending further orders. In view of the above, the cause in the present writ petition does not survive and the writ petition becomes infructuous.

In view of the submission made by the learned standing counsel for the 1st respondent University, the writ petition is dismissed as infructuous.
