HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13285 OF 2017 ORDER:

The case of the petitioners is that they have filed appeal before the 2nd respondent against the order dated 13.12.2016 passed by the Tahasildar along with stay petition, but no orders are passed till date. Meanwhile the respondents are trying to evict the petitioners. Aggrieved by the same, present writ petition is filed.

Learned counsel for the petitioners submits that petitioners have already raised fish culture in the subject lands.

Heard learned Assistant Government Pleader for Revenue.

In view of the fact that statutory appeal is pending before the 2nd respondent against the order dated 13.12.2016 passed by the 3rd respondent, the 2nd respondent is directed to dispose of the appeal within a period of two months from the date of receipt of a copy of this order, after issuing notice to the petitioner as well as affected parties, if any. Till such time, Status quo granted on 13.04.2017 shall continue. As far as harvesting of fish is concerned, it is open for the petitioners to make representation before the 3rd respondent and the 3rd respondent shall consider the same and pass orders.

With the above direction, the writ petition is disposed of. No order as to costs.
