ORDER

This petition is filed by the petitioners/A-3 and A-4 under Sections 437 and 439 of the Code of Criminal Procedure, 1973 seeking to grant bail in Crime No.103 of 2016 of Samalkot Police Station, East Godavari District, registered for the offences punishable under Section 8(c) read with 20(b)(i) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard and perused the material available on record. Case of the prosecution is that on 8.5.2016, the petitioners herein/A-3 and A-4 along with two others were found transporting 55 kgs. and 800 grams of ganja illegally.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and they have been falsely implicated in the present case. The petitioners were arrested on 9.5.2016. The petitioners were found in possession of 55 kgs. and 800 grams of ganja. Since the ganja found is more than the commercial quantity and considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners.
