THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12138 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused No.2 in FIR.No.742 of 2025 of Mailardevpally Police Station, Cyberabad Police Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 27.07.2025 the de-facto complainant lodged a report before the police stating that the complainant and his brother by name Dastagiri went to Happy wines, Mailardevpally to have alcohol, after consuming alcohol they stepped outside to purchase cigarette and stood at counter, at that time one person came and stepped (trampled) on his foot, then the complainant pushed him away, meantime he came along with some of his friends and he took the glass beer bottle and beaten the complainant so he received some bleeding injuries on his head and face and his friends also beaten him with hands, in the meantime the complainant brother Dastagiri came in between to stop him but the
above said accused person beaten Dastagiri also with glass Beer bottle then he also received blood injures on his head and face and after that they escaped from there, after that they got to know that his name as Sohel. Hence, he requested to take necessary action. Basing on the said compliant, the police registered a case in Cr. No. 742 of 2025 under Sections 109 (1) r/w Section 3 (5) of BNS.

Heard Sri K. Shrikanth Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and the petitioner herein also lodged a report before the police for the alleged offences and a case is also registered against the de-facto complainant. It is further submitted that all the other accused were already released on bail. It is further submitted that the petitioner herein is in jail from
04.08.2025. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that an offence under Section 109 (1) of BNS is already altered and a chargesheet was already filed on 21.08.2025. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail from 04.08.2025 and the investigation is already completed and a chargesheet is also filed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions.
i.
The petitioner/accused No.2 shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XII Additional Judicial Magistrate of First Class, Ranga Reddy District, at Rajendranagar.
ii.
The petitioner/accused No.2 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner/ accused No.2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
