O R D E R

Based on the complaint of the 4th respondent, case in Cr.No.49 of 2018 was registered against the petitioner for the offences punishable under Sections 420, 468 and 471 of IPC, on the file of Markapur Rural Police Station, Prakasam District, Andhra Pradesh. The grievance of the petitioner is that without following the procedure under Section 41-A of Cr.P.C., police authorities are threatening to arrest him. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Having regard to the facts and circumstance of the case and the submissions of the learned counsel, writ petition is disposed of directing the 3rd respondent - Station House Officer, Markapur Rural Police Station, Markapur, Prakasam District, to following the procedure under Section 41-A of Cr.P.C. and the guidelines laid down by Apex Court in ARNESH KUMAR vs. STATE OF BIHAR1 and take action in accordance with law. Interlocutory applications pending, if any, shall stand closed. No costs.
