THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.22986 of 2012 ORDER:
This Writ Petition is filed by the petitioner challenging the proceedings dt.18.01.2012 issued by the District Collector, Khammam(1st respondent) declining permission to the petitioner to cut the Teak trees situated in the land admeasuring Ac.1-14 guntas in survey No.381 of Tatkuru village, Velerupadu Mandal, Palvoncha Division of West Godavari District. 2.
In the said order, the District Collector, Khammam stated that the petitioner has to approach the Special Deputy Collector(Land Acquisition), ISP Unit-I, Paloncha for consideration of his request to cut the Teak trees existing in his land.

It is not in dispute that subsequently the parcel of the land belonging to the petitioner, which was acquired for Polavaram Irrigation Project, on bifurcation of the erstwhile State of Andhra Pradesh into new State of Telangana and residuary State of Andhra Pradesh, was merged with the West Godavari District in the residuary State of Andhra Pradesh.

The Government Pleader for Land Acquisition appearing for the 3rd respondent states that the Special Deputy Collector, Khammam District, who is the Land Acquisition Officer, ISP, UNIT-I Paloncha, will recommend to the District Collector, West Godavari for according permission to cut and take away the
trees and stated that appropriate direction be issued in this regard.

In view of the submissions of the Government Pleader for Land Acquisition, petitioner is directed to make a representation to the Special Deputy Collector, Kukunoor, West Godavari District as well as to the District Collector, West Godavari, Eluru seeking permission for cutting the Teak trees existing over his land within a period of two (02) weeks from the date of receipt of a copy of this order; the Special Deputy Collector, Kukunoor shall then make appropriate recommendation to the District Collector, West Godavari, Eluru for according permission to cut the Teak trees; and within four(04) weeks from the date of receipt of such recommendation of the Special Deputy Collector, Kukunoor, the District Collector, West Godavari, shall take appropriate decision in the matter and communicate his decision to the petitioner.

With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions pending if any shall stand closed.
