Heard counsel for petitioner and the Assistant Government Pleader.

The petitioner prays for Mandamus declaring the action of respondents 2 and 3 in interfering with the family dispute (civil in nature) and disturbing peaceful life of petitioner on a false report, as illegal, arbitrary and unconstitutional. The 3rd respondent filed counter affidavit denying the allegations made in the affidavit. The 3rd respondent further states that as on the date of filing the counter affidavit, no complaint was received against the petitioner and there was no occasion to summon the petitioner.
