HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16122 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the inaction of the respondents in filling up the posts of attender in the High School Section of HCM Junior College in the 4th respondent institution without finalizing the petitioner's case for regularization as per G.O.Ms.No.231 dated 16.10.1998, as illegal and arbitrary. A consequential direction is also sought to set aside the notification dated 08.05.2003 to fill up the posts to the extent of attender and to regularize the petitioner's post with effect from 1998 with all consequential benefits.

When the matter is taken up for hearing, it is brought to the notice of this Court that vide orders dated 01.08.2003, this Court directed the respondents not to finalize the appointment with regard to the post of attender notified at serial No.7, with reference to the advertisement dated 08.05.2003 issued by the 4th respondent college and the interim orders were made absolute vide orders dated 10.12.2004. In view of the above, the case of the petitioner can be considered for regular appointment, according to the Rules, if he is still continued in service and he is otherwise suitable and eligible. With the above observation, the writ petition is disposed of.
