THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.12531 OF 2017 AND WRIT PETITION No.26453 OF 2017 COMMON ORDER:

Petitioners claim that they purchased land to an extent of Ac.1.00 each in Survey No.131 of Bahadurpally Village, Gandimaisamma Dundigal Mandal, Medchal District, in the year 1994 and since then they are in possession and enjoyment of the said property. Petitioners state that they belong to Scheduled Caste category. In W.P.No.12531 of 2017, the petitioners contend that aggrieved by the orders, dated 25.04.2005, passed by the Deputy Collector and Mandal Revenue Officer, they preferred appeal before the Revenue Divisional Officer and the said appeal is pending consideration. While so, the respondents are trying to evict the petitioners from the subject land.

During pendency of W.P.No.12531 of 2017, the Revenue Divisional Officer passed orders on 26.05.2017 upholding the orders passed by the Deputy Collector-Mandal Revenue Officer. Aggrieved thereby, petitioners filed W.P.No.26453 of 2017. The petitioners now contend that aggrieved by the orders of the Revenue Divisional Officer, they preferred revision before the Joint Collector and the said revision is pending.

Having regard to the fact that the Revenue Divisional Officer has already passed orders in the appeal preferred by the petitioners, the cause in W.P.No.12531 of 2017 does not survive for adjudication and the Writ Petition is accordingly dismissed.

Since the petitioners have availed the remedy of revision against the orders of the Revenue Divisional Officer, this Court is not inclined to entertain W.P.No.26453 of 2017 and keep the same pending.

W.P.No.26453 of 2017 is disposed of directing the Joint Collector, Medchal-Malkajgiri District, at Keesara, to consider the revision preferred by the petitioners as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order.

There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in these Writ Petitions shall stand closed.
