This appeal is filed under Order XLIII Rule 1 read with Section 104 C.P.C. assailing the order dated 17.11.2005 passed in I.A.No.218 of 2005 in O.S.No.31 of 2005 on the file of the Court of the Senior Civil Judge, Medak, Medak District. Learned counsel for the appellant submitted that the purpose of filing the appeal has become infructuous. In view of the submission made by the learned counsel for the appellant, the Civil Miscellaneous Appeal is dismissed as infructuous. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
