SIVA SANKARA RAO WRIT PETITION No.24031 of 2015 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to pass order or orders direction more particularly in the nature of Writ of Mandamus or any other appropriate writ, order by declaring the action of the respondent bank in taking physical possession through Notice demanding possession dated 08-06-2015, in respect of All that the Said property bearing Municipal No. 3-1-111, admeasuring 327 Sq.
yards, situated at Moti Market, Esamia Bazar, Hyderabad, consequently set aside any other proceedings of the respondent Bank as illegal, arbitrary against the principles of natural Justice and unfair and pass such other orders or order to which the petitioner is entitled to be in the interest of justice and to pass such other order or orders as this Hon'ble Court may deems fit, just and proper in the circumstances of the case." By order dated 03.08.2015, this Court granted stay of further proceedings pursuant to the possession notice dated 08.06.2015 subject to the petitioner paying 50% of the amount due to the respondent bank.
It is now stated by the learned counsel appearing for the parties that the loan account of the petitioner has been cleared in its entirety by payment of the total outstanding dues.
In that view of the matter, the writ petition does not survive for consideration on merits and it is accordingly closed. Any title documents relating to the secured interest shall be returned by the respondent bank in accordance with the due procedure. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
