THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 44075 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. Since this Court is not adjudicating the matter on merits, it may not be necessary to issue notice to the unofficial respondents.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the order passed by respondent No.4 in Appeal No.D/ 790/ 2009 under Section 5B of A.P.Rights in Land and Pattadar Pass Books Act, in respect of land in Survey No.283/ C admeasuring Acs.3.39 guntas of Baddipalli Village of Karimnagar Mandal and in not considering the stay application in a revision filed against appeal No.D/ 790/ 2009, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioner submits that he filed a revision against the orders passed by RDO in Appeal No.D/ 790/ 2009 and the same is pending consideration. It is his case that though revision was filed on 23.11.2016 and interim application seeking stay of the order was filed along with the revision, till date no orders are passed in the revision.

Learned Government Pleader submits that if the revision filed by the petitioner is in order, the respondent-authorities may be directed to consider the revision or the interlocutory application filed along with the revision, at the earliest.

Having regard to the above, the present writ petition is disposed of directing the Joint Collector, Karimnagar - respondent No.3 to dispose of the revision or the interlocutory application filed by the petitioner along

with the revision challenging the order passed by the RDO in appeal No.D/ 790/ 2009, within a period of four to six weeks from the date of receipt of a copy of the order, if the same is in order. Till such time, status-quo as on today to be maintained with regard to entries and possession in respect of the property in dispute. There shall be no order as to costs.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
