ORDER
This writ petition is filed seeking to declare the inaction of the 2nd respondent in rejecting the application of the petitioner for compassionate appointment, as arbitrary and illegal.
The mother of the petitioner viz., R.Durgabai worked as Higher Grade Assistant in the respondent-Corporation and died on 23.09.2000. Her father was arrayed as an accused in the criminal case and thereafter, he was acquitted of the same. Hence, N.Leelabai, who is senior maternal aunt, was appointed as guardian of the petitioner. After attaining majority, she approached First Additional District Court, Krishna, Machilipatnam, for discharge of her guardianship and vide order dated 20.01.2014, the petitioner was declared as major. Thereafter, she filed an application in the month of October, 2015 seeking appointment on compassionate grounds. But, the respondent-Corporation vide order dated 17.11.2015 rejected the same. Hence, the present writ petition is filed. A perusal of the impugned order dated 17.11.2015 passed by the respondent-Corporation shows that the case of the
petitioner for appointment on compassionate grounds was rejected on the ground of delay. As per Central Office Instructions of the respondent-Corporation, the time limit for consideration of compassionate appointment to the minor children of the deceased employee is only three years from the date of death of the employee, provided, none of the family members of the deceased employee are gainfully employed as on the date of compassionate appointment. Appointment on compassionate grounds is a scheme meant for minimizing the difficulties arising on account of sudden death of the employee. No direction can be issued by this Court for consideration of the cases like that of the petitioner after lapse of prescribed time by the Corporation. In the circumstances, this Court is not inclined to interfere with the impugned order dated 17.11.2015 passed by the respondent-Corporation.
Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 16th September, 2016 rkk
