THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17110 of 2016 O R D E R:
This writ petition is filed seeking a direction to the 2nd respondent to release the Bolero vehicle bearing No.TS04 AU 5439, which was seized on 12.12.2015.
The case of the petitioner is that on 12.12.2015 one Ch.Prasad engaged Bolero vehicle bearing No.TS04 AU 5439 belonging to the petitioner on hire basis for transportation of rice and when the said vehicle reached Tunikuntla Village, being driven by the driver of the petitioner, the 3rd respondent intercepted the vehicle and found the vehicle transporting PDS rice consisting of 14 qtls. and thereby seized the said vehicle under cover of panchanama. It is further submitted that the petitioner filed a petition before the 2nd respondent for release of the vehicle. Since the 2nd respondent was not passing any orders, petitioner filed the present writ petition alleging inaction. Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies.
Considering the submissions made by both the counsel, this writ petition is disposed of directing the 2nd respondent to release the seized vehicle i.e. Bolero vehicle bearing registration No.TS04 AU 5439 in favour of the petitioner subject to condition of his furnishing Bank Guarantee for a sum of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand only). However, release of seized vehicle shall be subject to the further orders that may be passed by the authorities after due enquiry in accordance with the provisions of law. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. _____________________________ CHALLA KODANDA RAM, J.
