THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26698 OF 2018 ORDER:
The grievance of the petitioner in the present Writ Petition is that without obtaining any valid permission from the respondent-Corporation, certain people are erecting arches, hoardings, flex-boards etc., and causing hindrance to the free movement of the traffic and the said activity leading is also to deaths also.
It is submitted by the learned Counsel for the petitioner that the Corporation is bound to insist on the persons, who want to erect such things, to obtain permission before doing so under Sections 420 and 421 of the H.M.C.Act, 1955 and the same is not disputed by the learned Standing Counsel for the respondent-Corporation.
It is reported today that after completion of Bonalu festival, the G.H.M.C. initiated action for removal of temporary arches, hoardings etc., erected by the local people and removed the same.
Having heard the learned Counsel for the petitioner and the learned Standing Counsel for the respondent-Corporation and as there is no dispute with regard to the legal position, as mentioned supra, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the respondent-Corporation to strictly enforce the provisions of Sections 420 and 421 of the H.M.C.Act, 1955 and also the instructions issued by the State Government vide G.O.Rt.No.1163 M.A., Municipal
Administration and Urban Development (F2) Department, dated 31.12.1996.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
