The present Writ Petition, under Article 226 of the Constitution of India, came to be filed with the following prayer: "...to issue a writ or order or orders or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the respondents in not issuing the pattadar pass books and title deeds in favour of the petitioner society of land an extent of acre 3.38 cents covered by patta No.152 in survey No.1/4 of Rushikonda village, Endada Grampanchayat, Visakhapatnam Rural & Mandal and District as illegal, arbitrary, unjustified, contrary to law and consequently direct the respondents to issue a pattadar pass book and title deed infavour of the petitioner society the land an extent of Ac.3.38 cents covered by patta No.152 in survey No.1/4 of Rushikonda village, Endada Grampanchayat, Visakhapatnam, Rural and Mandal and District."

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent authorities to consider the representation dated 05.05.2005 made by the petitioner seeking issuance of pattadar pass book and title deed at the earliest. 3.

It is to be noted that a direction was given on 29.06.2005, wherein the respondents were directed to dispose of the representation dated 05.05.2005, within eight (08) weeks from the date of receipt of a copy of the order. But the petitioner is not in a

position to say as to whether his representation was considered or not.

Learned Government Pleader for Revenue would submit that if the representation made by the petitioner is not considered and no orders are passed till date, the petitioner may be directed to make a fresh application under Form 6A, in which event the same will be considered by the authorities in accordance with law. 5.

In view of the submissions made across the Bar, the Writ Petition is disposed of directing the petitioner to make a fresh application seeking issuance of pattadar pass book and title deed, if the earlier representation dated 05.05.2005 is not considered till date, in which event, the respondent authorities shall consider the same at the earliest, in accordance with law. If any order is passed in view of the direction of this Court, a copy of the said order shall be communicated to the petitioner forthwith.
