Heard Sri E.V.V.S. Ravi Kumar, learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development for Respondent No.1 and Sri N. Praveen Kumar, learned counsel appearing for the respondent No.2. The notice bearing No.G-1/49/2018, dated 21/7/2018, issued by the Commissioner, Municipal Council, Bhainsa, Nirmal district is under challenge in the present writ petition.
2. The sum and substance of the case of the petitioner in the writ petition is that though the petitioner herein submitted an explanation on 28/7/2018 to the impugned notice dated 21/7/2018, the respondent-Municipal authorities are actively contemplating to pull down the subject construction without considering the contents of the said explanation.
3. Since the petitioner already submitted his explanation to the impugned notice dated 21/7/2018 on 28/7/2018 and as the same is pending consideration before the respondent/municipality, this Court having heard the learned counsel for the petitioner and
the learned standing counsel, deems it appropriate to dispose of this writ petition with a direction to the second respondent to verify the explanation dated 28/07/2018 said to have been submitted by the petitioner in response to the impugned notice dated 21/07/2018 and pass appropriate orders on merits strictly in accordance with law within a period of six weeks from the date of receipt of a copy of this order. Till such exercise attains finality, no coercive steps pursuant to the impugned notice dated 21/07/2018 with regard to the subject construction covered by the impugned notice shall be taken.
4. With the above direction, this writ petition is disposed of at the stage of admission. No costs.
5. As a sequel, miscellaneous petition if any, pending in this writ petition shall stand closed.
