THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8908 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners who are arrayed as Accused Nos.1 and 2 in the event of their arrest in connection with Crime No.372 of 2022 on the file of Station House Officer, Balanagar Police Station, Cyberabad registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 506 read with Section 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioners/Accused Nos.1 and 2 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case in brief are that the complaint is filed alleging that these petitioners have induced the de facto complainant into parting huge amounts on the promise of returns. It is specifically alleged that if Rs.50 Lakhs were invested, the de facto complainant would get Rs.8 Crores. Believing the said version, the amounts were given by the de facto complainant to the petitioners.

According to the complaint, since there are several money transactions this Court is not inclined to grant anticipatory bail to 1st petitioner/Accused No.1. However, keeping in view that the 2nd petitioner/Accused No.2 is household woman, the relief of anticipatory bail for the 2nd petitioner/Accused No.2 can be considered.

Accordingly, 2nd petitioner/Accused No.2 shall be enlarged on bail in the event of her arrest subject to the following conditions: i) The 2nd petitioner/Accused No.2 is directed to surrender before the Station House Officer, Balanagar Police Station, Cyberabad within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction. ii) The 2nd petitioner/Accused No.2 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii) The 2nd petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

The Criminal Petition in so far as 1st petitioner/Accused No.1 is concerned for grant of anticipatory bail is refused and dismissed. 7.
