THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Writ Petition No.17379 of 2016 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The relief sought for in this writ petition is to declare the detention notice dated 30.12.2015, detaining the consignment covered by invoice dated 30.12.2015, as illegal and arbitrary. Sri S.Suri Babu, learned Special Standing Counsel for Commercial Taxes, would submit that, by proceedings in Form VAT 605 dated 13.06.2016, an order of confiscation was passed. A copy of the said order is also handed over to Sri Chittem Venkat Reddy, learned counsel for the petitioner, across the Bar. As the subject goods have been confiscated, the validity of the earlier detention notice cannot be examined in the present proceedings.

Suffice it to make it clear that this order shall not preclude the petitioner, if they so choose, from questioning the validity of the order of confiscation in appropriate legal proceedings. The writ petition is dismissed as infructuous. The miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
