THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21112 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to issue a writ of mandamus or any other appropriate writ or direction in not considering the representation of the petitioner dated 20.06.2016 and proceeding ahead to invoke the bank guarantee as illegal, arbitrary and consequently direct the respondents No.2 and to consider the representation of the petitioner and pass...

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Prohibition and Excise for the State of Andhra Pradesh appearing for respondents. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. Though various grounds are urged in the Writ Petition, learned counsel for the petitioner submits that though the petitioner made a representation dated 20.06.2016 to respondent No.3, he is taking steps for invocation of the bank guarantee for recovery of the license fee payable without considering the representation. Learned Assistant Government Pleader submits that respondent No.3 has to take appropriate

decision on the representation of the petitioner.

4. Having regard to the circumstances of the case, the Writ Petition is disposed of directing respondent No.3 to pass appropriate orders on the representation dated 20.06.2016 made by the petitioner in accordance with law, within a period of four weeks from the date of receipt of a copy of this Order. Till such time, the authorities shall not take any coercive steps like invoking bank guarantee. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
