THE HON'BLE SRI JUSTICE S.V.BHATT Writ Petition No.35238 of 2016 ORDER :

The learned counsel consented to dispose of the Writ Petition and accordingly, the Writ Petition is heard and the following order passed : Mr.Aka Venkataramana, appearing for Mr.P.V.Narasimha Rao Telangana Veterinary University - 4th Respondent, submits that as on date seven seats of B.Tech (Dairy Technology) which have fallen to the share of State of Andhra Pradesh remain unfilled. He further submits that in respect of these seven seats, the power of allotment is with Sri Venkateshwara Veterinary University - 6th Respondent, since no allotment is made, the 4th respondent is unable to fill the seats.

Sri Y.V. Anil Kumar places on record written instructions, dated 27-10-2016. One of the instructions read thus : "On completion of counselling process, if any leftover seats are there, it is prerogative of respective institute to take up spot admissions by following regular counselling process." From the above it is clear that at the first instance, the 6th respondent could not allot students to 4th respondent - University and further leaves it to the discretion of 4th respondent to take up admission for unfilled seats. This Court, having regard to vacant position and the stand of 6th respondent, directs the 4th respondent to consider the case of the

petitioner for admission into B.Tech (Dairy Technology) in unfilled seven seats forthwith.

The Writ Petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
