The case of the petitioner is that the petitioner-society filed application to update the newly elected Managing Committee of the petitioner-society and the same was rejected on the ground that there is dispute among them vide endorsement dated 04-11-2015. The petitioner challenged the same by way of W.P.No.39726 of 2015 and it was set aside and the 2nd respondent was directed to reconsider the request of the petitioner-society and pass appropriate orders and gave liberty to get it confirmed from the Principal District Judge, Visakhapatnam, regarding pendency or otherwise of O.P.No.1053 and 1124 of 2007. The 2nd respondent addressed letter to the District Judge and the District Judge informed that the OPs were dismissed for default and restoration applications filed in I.A.No.2307 of 2014 and I.A.No.2308 of 2014 in OP.Nos.1124 and 1053 of 2007 respectively were dismissed on 08-07-2016. Inspite of the same, again endorsement dated 19-08-2016 was issued by the 2nd respondent stating that dispute among the Managing Committee of the petitioner-society.

Learned Assistant Government Pleader for revenue took time on two occasions to find out whether any

dispute is pending. Again sought for time for seeking instructions.

By order dated 08-07-2016 in I.A.No.2307 of 2014 in O.P.No.1053 of 2007 and I.A.No.2308 of 2014 in O.P.No.1124 of 2007 both restoration applications are dismissed. No information is produced to say that any litigation is pending regarding Managing Committee of the petitioner-society.

Having regard to the above, impugned endorsement is set aside and the 2nd respondent is directed to take action on the representation dated 08-01-2016, in accordance with law, for updating the list of members of Managing Committee of the petitioner-society within a period of six (06) weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
