HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.32812 of 2017 ORDER:

Heard Sri Raja Reddy Koneti for petitioners and the Assistant Government Pleader (Home) for respondents. The petitioners pray for Mandamus declaring the action of the 5th respondent herein in calling the 2nd petitioner to police station on 18.09.2017 for settlement of civil dispute pertaining to property bearing Door No.1-35/ 49, Sanjay Gandhi Nagar, Gandhamguda Village, Peeramcheru Grampanchayat, Gandipet Mandal, Ranga Reddy District, as illegal and unconstitutional.

The Assistant Government Pleader, basing on written instructions, dated 04.10.2017, submits that in the Court referred case, the respondents registered Cr.No.506 of 2017 dated 18.07.2017 and the 2nd petitioner is shown as Accused No.3. In other wards, there is no crime registered against the 1st petitioner. On the allegations of petitioners that the 5th respondent is summoning the 2nd petitioner to police station, it is denied and further stated that the 5th respondent is concerned with the investigation of Cr.No.506 of 2017 pending against 2nd petitioner and also that exc ept investigating the crime, the respondents are not interfering with the civil dispute or pressurizing the petitioners in any manner.

By accepting the statement made in the written instructions, the writ petition is disposed of by this order. Respondents 4 and 5 are free to investigate Cr.No.506 of 2017 and it is made clear that except as required by law, the respondents shall not summon the petitioners to Police Station either in the crime pending or in any other matter. The writ petition is disposed of accordingly. No order as to costs.
