HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26950 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondents in not registering the crime and investigating the petitioner's complaint dated 17.05.2018.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that petitioner sent Photostat copies of the complaint to all the officials including 6th respondent; that after receiving the said complaint, the 6th respondent called the petitioner through a police constable with a view to get the original copy of the said complaint which was sent through registered post, for taking necessary action against the said complaint, but the petitioner is not available; and that preliminary enquiry was conducted against the allegations in the said complaint and also found to be false. It is also stated that if petitioner files a signed complaint, they will take necessary action.

In view of the aforesaid submission, it is open for the petitioner to file a fresh complaint and on such filing the concerned authority is directed to take action in accordance with the guidelines laid down by the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
