This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.3 in Crime No.486 of 2022 on the file of Station House Officer, SR Nagar Police Station, Hyderabad, registered for the offence under Section 8(c) read with Section 22(c), 27 of NDPS Act. 2.
Heard learned counsel for the petitioner/Accused No.3 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

This Court by orders dated 17.08.2022 and 22.09.2022 granted bail to Accused Nos.1 and 2 vide Crl.Petition No.6701 of 2022 and Crl.Petition No.8300 of 2022 respectively on the ground that the investigating officer had mixed the substances which were found from Accused Nos.1, 2 and 3 without determining whether the three substances are the same or not. In the said circumstances, the benefit of bail was extended to Accused Nos.1 and 2.

In view of the aforesaid orders passed by this Court, the petitioner/Accused No.3 stands on the same footing, for which reason, the petitioner also can be granted the relief of regular bail, subject to the following conditions:
i) The petitioner/Accused No.3 is directed to be released on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum, to the satisfaction of III Additional Chief Metropolitan Magistrate at Hyderabad.
ii) After release on bail, the petitioner/Accused No.3 shall appear before the concerned police station on every Monday between 10.00 A.M to 1.00 P.M, for a period of three months. iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 5.
Accordingly, the Criminal Petition is allowed and copy of the orders passed by this Court in Crl.Petition Nos.6701 of 2022 and 8300 of 2022 shall form part of this order.
