THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.28078 OF 2007

ORDER

The writ petition is filed questioning the action of the 3rd respondent in orally disengaging the petitioner from service in pursuance of the order dated 25.120.2007, passed by this Court in W.P.No.19628 of 2006.

It is the case of the petitioner that aggrieved by the removal of his service, he had approached this Court by filing W.P.No.19628 of 2006 and which came to be allowed by order dated 25.12.2007 setting aside the award dated 2.12.2004, passed by the Labour Court, Guntur in I.D.No.2 of 2003. Pending disposal of the said writ petition, petitioner was reinstated into service in terms of the award dated 2.12.2004 passed by the Labour Court, Guntur. After the disposal of the writ petition, petitioner was sought to be disengaged. Aggrieved with the same, the petitioner again filed the present writ petition. This Court granted interim stay and now the matter is listed for final hearing.

Today, when the matter is taken up for hearing, learned counsel for the respondents submits that the petitioner is continuing in the service and after remanding the matter to the Labour Court, the Labour Court has also disposed of the I.D.No.2 of 2003. As of now as the petitioner had approached only aggrieved with the disengagement and considering the fact that he has already been reinstated into service, the relief claimed in the writ petition stands granted. Accordingly, the writ petition is closed. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed.
