COMMON ORDER:- (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) The petitioner as well as private respondent in both the writ petitions are common.

2. The private respondent, by name A. Raghuram, filed OA No.8740 of 2002 before the Andhra Pradesh Administrative Tribunal (for short 'the Tribunal') feeling aggrieved by the action of the Respondent No.1 in WP No.3201 of 2004 in rejecting his claim for promotion. The petitioner filed OA No.9955 of 2002 claiming promotion. By a common order dated 11.02.2004, the Tribunal has allowed OA No.8740 of 2002 filed by the private respondent and dismissed OA No.9955 of 2002 filed by the petitioner.

3. At the hearing, Smt. B. Vijayalakshmi, learned counsel for the petitioner submitted that notwithstanding the impugned order of the Tribunal, the petitioner is being continued as Superintendent and that therefore, there is no need for adjudication of these writ petitions on merits.

4. In the light of the above submission of the learned counsel for the petitioner, these two writ petitions are disposed of as infructuous. No order as to costs.

5. As a sequel to dismissal of the writ petitions, W.P.M.P. No.4232 of 2004 in WP No.3201 of 2004 and W.P.M.P.Nos.4698 & 4477 of 2004 in WP No.3568 of 2004 are disposed of as infructuous. _________________________ C.V.
