HIGH COURT FOR THE STATE OF TELANGANA : HYDERABAD MAIN CASE NO: W.P.No.31149 of 2023 PROCEEDING SHEET 13.03.2026 TMD,J Rev.I.A.No.1 of 2025 in W.P.No.31149 of 2023 This Review Application is filed by the petitioner seeking review of the order dated 30.04.2025 passed by this Court in W.P.

No.31149 of 2023. It is submitted that the writ petition was dismissed by this Court on the ground that the petitioner had not challenged the cancellation order dated 04.04.2006.

Learned counsel for the petitioner draws the attention of this Court to the fact that the petitioner had, in fact, challenged the said cancellation order in W.P.

No.15921 of 2006, which was allowed by this Court by order dated 07.09.2006. In the said order, the impugned cancellation order was set aside on the ground that it was issued without prior notice to the petitioner. This Court had also directed the Mandal Revenue Officer (MRO) to issue notice to the petitioner and thereafter pass appropriate orders in respect of the

assignment of house site patta relating to land admeasuring 100 square yards in Survey No.513. It is submitted by the learned counsel for the petitioner that the MRO has not taken any further steps pursuant to the directions issued by this Court and the matter is still pending and in the meantime, the petitioner has made an application seeking building permission and since the same was not granted, the petitioner filed W.P. No.31149 of 2023.

Having perused the order passed by the then Andhra Pradesh High Court in W.P. No.15921 of 2006, this Court is satisfied that the cancellation order dated 04.04.2006 was, in fact, challenged and set aside by this Court. Since the said fact was not brought to the notice of this Court at the time of hearing, W.P. No.31149 of 2023 came to be dismissed.

In view of the above circumstances, the order dated 30.04.2025 is hereby recalled and restored to its file.

W.P.No.31149 of 2023 The Registry is directed to list this matter before the appropriate Bench having roster.
