HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.26804 of 2018 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 07-02-2018, whereby and whereunder the candidature of the petitioner for award of LPG distributorship of BPC at Kukkambakam, Chittoor district was rejected, as being illegal arbitrary and contrary to the terms of the Unified Guidelines for Selection of LPG Distributors, 2017, and for issuance of appropriate consequential directions.
Learned counsel for the petitioner submits that rejection of the petitioner's candidature by the impugned order for appointment of LPG distributorship on the ground of suppression of fact is illegal as the petitioner in the application form clearly stated his place of residence as BN Kandriga Gram Panchayat which comes within the BN Kandriga mandal and revenue sub-division and, therefore, the question of suppression of fact does not arise. On the other hand, learned standing counsel for the respondents submits that in the application, the petitioner to
the information, as to whether the Gram Panchayat in which the applicant resides is the same as the Gram Panchayat of the advertised location, stated "Yes" and based such a statement made in the application, the petitioner's application was considered and he was declared as selected for award of LPG distributorship as he was the lone eligible applicant in the inter-se priority List-1, but at the time of field verification, it was found out that the petitioner is a resident of BN Kandriga Gram Panchayat, whereas the Gram Panchayat of the advertised location is Kukkambakkam and as such the candidature of the petitioner was rejected as it affects the eligibility criteria for inter-se priority List-1.
It is to be seen that in the field verification it was found out that the place of residence of the petitioner is different from the place of advertised location.

The Gram Panchayat limits of the petitioner in which he resides is differently stated from the Gram Panchayat of the advertised location which goes to show that the petitioner has misrepresented the information as to his place of Gram Panchayat in which he resides. In the circumstances, there are no grounds to interfere with the impugned order rejecting the candidature of the petitioner for award of LPG distributorship. In the result, the writ petition fails and it is accordingly dismissed. Miscellaneous petitions if any pending shall stand disposed of.
