THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8915 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail to the petitioner/accused in the event of his arrest in connection with Crime No.287 of 2022 of Bhadrachalam Police Station, Bhadradri Kothagudem District, registered for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for the petitioner/accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that he is fertilizer dealer and in the course of his business, he supplied fertilizers to the deceased M.Srinivasa Rao on credit basis. For the outstanding due amount, the petitioner allegedly went to the house of the deceased and insisted for the amount to be paid. Further, he had repeatedly called the deceased over phone and also posted some messages on WhatsApp group. The deceased was aggrieved by the consistent visits of the petitioner and entering into fight regarding the outstanding amount and also for posting messages in WhatsApp group, committed suicide. 4.
As seen from the complaint, the petitioner/accused had been insisting the deceased for the money which was due to him. However,
the petitioner acted in excesses for which reason, the deceased committed suicide. However, considering the financial transactions in between the petitioner and the deceased, the petitioner can be granted the relief of anticipatory bail subject to following conditions:
1) The petitioner/accused is directed to surrender before the Station House Officer, Bhadrachalam Police Station, Bhadradri Kothagudem District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused on bail, on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.
2) On such release, the petitioner/accused shall report before the said Station House Officer on every day between 10.00 a.m. and 4-00 p.m., for a period of three weeks.
3) The petitioner/accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
