THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12182 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused No.2 in FIR No.720 of 2025 of Attapur Police Station, Cyberabad Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 31.08.2025, the de-facto complainant lodged a report before the police stating that on 31.08.2025 at about 19:00 hrs, the complainant, his friends Madhu, Shaik Faheemuddin (Injured) along with his family members were celebrating Ganesh Immersion in front of his house, the accused No.1 sprinkled beer water to them from 2nd floor. Later, the complainant along with his friend Shaik Faheemuddin came to him and asked him as to why he sprinkled the beer water, but the accused No.1 and his friend Rahul were abusing in filthy language and beat to the complainant and his family members with their hands and the accused No.1 tried beating to the complainant with beer bottle and the complainant escaped from the beer bottle, but the complainant's friend Shaik Faheemuddin received bleeding injuries on his head. Thus, the accused persons intention
was to kill them. Hence, he requested to take necessary action. Basing on the said complaint, the police registered a case in FIR No.720 of 2025 for the offences punishable under Sections 109 (1), 115 (1), 351 (2) r/w section 3 (5) of BNS. 3.
Heard Sri S. Venkat Ramana, learned counsel appearing on behalf of the petitioner/accused No.2 as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner/accused No.2 is innocent of the alleged offences and he is in jail from 01.09.2025. It is further submitted that the injuries sustained by the de-facto complainant's friend are simple in nature and the de-facto complainant has not sustained any injuries. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that the injury certificate also shows that the injuries sustained are simple in nature. Further, the investigation is not yet
completed. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner/accused No.2 herein is in jail from 01.09.2025. Further, LWs 1 to 12 witnesses were already examined and the injuries sustained are simple in nature. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused No.2, subject to the following conditions.
i.
The petitioner/ accused No.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XXV Additional Judicial Magistrate of First Class at Rajendranagar, R.R. District.
ii.
The petitioner/ accused No.2 shall appear before the concerned SHO at
11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner/ accused No.2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed and this Criminal Petition is not pressed for the petitioner/accused No.2.
Miscellaneous applications, if any pending, shall stand closed.
