THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.26706, 26714 AND 26716 of 2018 COMMON ORDER:

When these matters are taken up for hearing, counsel for the petitioners as well as Standing Counsel appearing for the respondents submitted that the issue raised in these writ petitions is squarely covered by the order passed by this Court in W.P.No.21936 of 2018 and batch, dated 12.02.2020, and contended that the present writ petitions also be disposed of in terms of the said order.

In view of the above submissions and for the reasons alike in the order dated 12.02.2020 passed in W.P.No.21936 of 2018 and batch, these writ petitions are also disposed of by remanding the matters back to the 1st respondent for fresh determination of Cross Subsidy Surcharge, after giving notice to the affected parties in terms of Clauses 16 (ii) and 17 of the Regulations prescribed by the 1st respondent and pass appropriate orders within a period of six months from the date of receipt of a copy of this order. It is needless to state that the petitioners are at liberty to raise all legal grounds in accordance with law. Any demand issued pursuant to the orders passed by the 1st respondent on 6.04.2018 shall automatically stand quashed. The 1st respondent shall decide the cases, which have been remanded by the Tribunal for the years 20042005 and 2005-2006. No order as to costs.
