HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.25189 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer and her authorization is valid upto 31.03.2016. While so, the Vigilance and Enforcement (CS), along with UDRI (CS), inspected the shop of the petitioner and prepared panchanama stating that there was variation in stock and initiated 6A proceedings. The petitioner states that neither her authorization was suspended nor cancelled but supply of commodities was stopped to her. Hence the Writ Petition.
It is needless to mention that, so long as the authorization of the petitioner is in force, she is entitled for supply of stock. However, learned Government Pleader for Civil Supplies has not produced any evidence to show that the petitioner's authorization was suspended, and any action was taken against her. In the circumstances, the Writ Petition is disposed of directing the respondents to release the stock to the petitioner for distribution to the cardholders so long as her authorization is in force.
