HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 1842 OF 2015 ORDER:

Heard learned counsel for petitioner and learned Public Prosecutor. At the admission stage, the following order is passed. Learned counsel for petitioner tried to canvas that the criminal proceedings are not maintainable on various factual and legal grounds. In the considered opinion of this Court, the petitioner/A3 can well canvas those grounds in a discharge application and in which case, the trial court shall pass suitable orders on merits. Further, considering the request of learned counsel for petitioner, the attendance of petitioner/A3 in C.C.No. 909 of 2013 on the file of First Additional Judicial First Class Magistrate, Tadepalligudem, West Godavari District, is dispensed with except on the occasions when the trial court requires his presence.
