Pupils Own High School Parents v. The State Of Telangana

Heard both sides.
This writ petition is filed challenging the action of respondents 1 to 3, 5 and 6 in closing the subject educational institution i.e. Pupils Own Primary School & Pupil's Own High School situated at premises No.12-1-1065 to 12-1-1068 and 12-1-1010, near mosque, north Lallaguda, Secunderabad for handing over the possession of the subject educational premises to respondent No.4.
The 6th respondent filed counter stating that the premises in question belongs to the 5th respondent, but it is not the property of the 6th respondent-school and that already the school management filed WP.No.18165 of 2018 when the 4th respondent issued proceedings under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and on the undertaking given by the schoolmanagement, time was granted till 31-07-2018 for vacating the subject premises on the condition that the 6th respondentschool shall pay rent of Rs.25,000/- per month for June and July, 2018 to the 3rd respondent-bank and vacate the subject premises by 31-07-2018.
It is to be seen that when the subject premises was put in auction, already the management of school i.e. the 6th respondent filed WP.No.18165 of 2018 and Division Bench of this Court granted time till 31-07-2018 for vacating the subject
premises, this Court cannot interdict the process. If the petitioners are aggrieved, they can seek appropriate remedy. In view of the same, I do not see any ground to entertain the writ petition and accordingly, the same is dismissed. As a sequel to the disposal of this case, miscellaneous petitions, if any, pending shall stand closed.
