HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1820 OF 2017 ORDER:
The case of the petitioners is that the 4th respondent issued proceedings dated 19.04.2016, 29.06.2016, 28.07.2016, 22.11.2016 for demolition of residential houses of the petitioners, a school building and the burial ground, under the guise of a water conservation mission, without following due procedure established under law. In respect of the same, the petitioners made a representation on 15.12.2016 to the 4th respondent. But without considering the same, the respondent authorities are trying to demolish the residential houses of the petitioners. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioners submits that petitioners are residents of Ikkurru Village, Narasaraopet Mandal, Guntur District and that they have constructed houses long back and have been living there since generations. He also submits that the Government has constructed a school and a water tank for welfare of the villagers living there. But the respondent authorities without considering the same, are trying to demolish the residential houses of the petitioners.
Heard the learned Assistant Government Pleader for Revenue.
Though counter affidavit is filed disputing the allegations of the petitioners, both the counsel submit that the writ petition can be disposed of with a direction to the 4th respondent to pass orders on the representation of the petitioners dated 15.12.2016.
In view of the above facts and circumstances, without going into the merits of the case, the 4th respondent is directed to dispose of the representation made by the petitioners on 15.12.2016 in accordance with law and take action accordingly. Till such time, the interim order granted on 19.01.2016 shall continue.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
