Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.19732 OF 2017 ORDER:
Petitioner is a Senior Accountant. He is aggrieved by the order, dated 05.10.2016, whereunder he was placed under suspension on the allegations of his involvement in a criminal case, his arrest and detention for more than 48 years. 2.
Learned counsel for the petitioner contends that there is no further progress in the investigation of the said criminal case and though no departmental action is initiated against the petitioner, he is continued under suspension and, as required, no review of suspension is undertaken. Learned counsel submits that though representations dated 14.02.2017 and 06.05.2017 were submitted by the petitioner ventilating his grievance, they were not acted upon and his further continuation of suspension is not reviewed. Learned counsel further contends that not undertaking the review of suspension and continuing the petitioner under suspension is illegal.
3.
Since representations submitted by the petitioner are not responded so far, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the Deputy Director, District Treasury Office, Ranga Reddy District, the 3rd respondent, to examine the claim of the petitioner against further continuation of his suspension as ventilated in his representations dated 14.02.2017 and 06.05.2017 and pass appropriate orders as warranted by law, by assigning due reasons in support of his decision, as expeditiously as possible preferably
within a period of four weeks from the date of receipt of a copy of this order. If the petitioner is aggrieved by the decision of the 3rd respondent, it is always open to him to work out his remedies. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
