HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6119 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies (TS).

2. This writ petition is filed seeking Writ of Mandamus declaring the action of the 2nd respondent in not allowing the petitioner to continue as fair price shop dealer of shop No.0182 of Chinthakunta Village, Karimnagar Mandal and District without following due process of law, as arbitrary and illegal.

3 . The petitioner is the temporary fair price shop dealer No.0182 of Chinthakunta Village. On the allegations of committing certain irregularities, the permanent dealer's authorisation for the said fair price shop was suspended by the authorities. Thereafter, by order dated 23.08.2014, the petitioner was appointed as a temporary dealer. So far no permanent dealer has been appointed. The grievance of the petitioner is that the respondents have not been allowing her to distribute the commodities and also they have not been allotting the essential commodities to her fair price shop.

4. Under these circumstances, the respondents are directed to continue the petitioner as temporary dealer by allotting the essential commodities to her for distribution among the cardholders, till the vacancy of the permanent dealer is filled up.

5. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
