HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.202 OF 2015 ORDER:

Having regard to the reasons stated in writ petition No.39209 of 2014, it is to be reiterated that this Court has accepted the plea of petitioner that the comprehensive offer given by the petitioner cannot be split up into portions, more particularly, after the petitioner has withdrawn the offer on 26.09.2014. Once the petitioner withdraws the offer, it is but natural that the respondents have to procure medicines only after following the procedure stipulated by issuing fresh tender. No exception to the issuance of impugned tender can be taken. The writ petition is dismissed. No order as to costs. The writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
