HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7601 OF 2017 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/ accused, seeking to quash the proceedings in Crime No.96 of 2017 on the file of Central Crime Station, Hyderabad, registered for the offences punishable under Sections 403, 406, 420, 468 and 471 I.P.C. Heard learned counsel for the petitioner, learned Public Prosecutor appearing for the State and learned counsel appearing for respondent No.2/ de facto complainant and perused the grounds in the Criminal Petition and the contents of the F.I.R. Though several contentions are raised on the very sustainability of the F.I.R., it is premature for this Court to go into the merits of the case and there is nothing to interdict the investigation. Having regard to the above, the Criminal Petition is disposed of, directing the police to proceed with the investigation and in the event of any necessity of arrest of the petitioner, they have to follow strictly Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1, as none of the offences are punishable above seven years.
