HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39450 OF 2016 ORDER:

The present writ petition is filed by the petitioners seeking to declare the inaction of the 3rd respondent in taking up the appeal, filed by the petitioners on 11.07.2016, against orders, dated 24.06.2016, passed by the Special Deputy Collector (TW), Polavaram, as illegal and arbitrary, and consequently, direct the 3rd respondent to take up the appeal. Heard and perused the material available on record. The main grievance of the petitioners is that even though they preferred an appeal before the 3rd respondent on 11.07.2016, against the order, dated 24.06.2016, passed by the Special Deputy Collector (TW), Polavaram, the 3rd respondent is not giving number to the appeal and not disposing of the same.

Considering the facts and circumstances of the case and also taking into consideration the grievance of the petitioners, without going into the merits of the case, this Court is inclined to pass the following order: The 3rd respondent is directed to give number to the appeal filed by the petitioners on 11.07.2016, and dispose of the same as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.

With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
