HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 10706 of 2017 Order:

This Writ Petition is filed challenging the registration of Crime No.87 of 2017 by the second respondent.

It appears that on the complaint of the first petitioner dated 03.03.2017, Crime No.103 of 2017 was already registered against the third respondent. The petitioners state that the present Crime No.87 of 2017 is a counter blast to the earlier crime and the registration of crime is bad in law. However, after reading the complaint lodged by the first petitioner and that of the third respondent, this Court is satisfied that the matter requires investigation. In the circumstances, the second respondent is directed to follow due process of law while investigating the crimes including compliance with Section 41-A of the Code of Criminal Procedure.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
