THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12186 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused in FIR No.884 of 2025 of Alwal Police Station, Cyberabad Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 24-8-2025, the police conducted a raid in brothel house at H.No.1-71/124/1, Reddy Enclave, beside Prasanth nagar, Select Talkies road, Old Alwal. The Complainant obtained permission from Asst.
Commissioner Police, PetBasheerabad division to search the premises. He along with panchas and woman police constables reached H.No.1-71/124/1, Reddy Enclave and knocked the door. Then one woman opened the door and upon enquiry the petitioner/accused revealed her name and confessed that for the last one and half years she is working as organizer of brothel houses at various places in Hyderabad by procuring women from various places in India to participate in sexual intercourse with the customers by collecting Rs. 1000/- to Rs.2000/-. Upon searching rooms it was observed that it consists of two bedrooms and kitchen. The complainant found two male persons in hall and a lady and male person in bed
room. The victim woman revealed her name as Bangutapu Kavitha w/o B Vijay Kumar and she revealed that she met the petitioner/accused one year ago and that she is participating in sexual intercourse with the customers. The complainant seized Rs.4000/-, condoms, 4 small phones, and one key pad phone and all of them were brought to P.S. for necessary action. A case was registered against the accused vide FIR No.884 of 2025 for the offences punishable under Sections 143 (3) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') and Sections 3 and 4 of the Prevention of Immoral Traffic Act, 1956.

Heard Sri Y. Hema Chander, learned counsel appearing on behalf of the petitioner/accused as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondentState. 4.
Learned counsel for the petitioner submitted that the petitioner herein is innocent of the alleged offences and the offence under Section 143 (3) of BNS is not applicable in this case, as there was only one victim found at the scene. It is further submitted that the petitioner herein is in jail from 24.08.2025. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that there are no other cases pending against the petitioner herein. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition. 6.
In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail from 24.08.2025. Further, the material part of the investigation was already completed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions.
i.
The petitioner/ accused shall execute a personal bond for a sum Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned X Additional
Metropolitan Magistrate, Cyberabad, at Medchal.
ii.
The petitioner/ accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose investigation, and thereafter, as and when required.
iii.
The petitioner/ accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
