THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 5662 OF 2013 ORDER:

This Writ Petition is filed to declare the action of the respondents in not taking action for shifting dumping yard from Ward No. 45, Mehar Nagar, Kakinada, East Godavari District, as illegal and arbitrary.

Heard both learned counsel.

At the hearing, learned standing counsel submitted that the dumping yard has been shifted. However, learned counsel for the petitioner has disputed the said fact passing on photographs of the subject place and submitted that there is lot of debris left in the subject place.

In view of the rival submissions, the respondents are directed to get the debris lifted lying in the subject place within a period of two weeks from today.

The Writ Petition is disposed of accordingly. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
