THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 10944 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.5 and 6 seeking bail in the event of their arrest in connection with Crime.No.640 of 2023 on the file of Jangaon Police Station, Warangal District, registered for the offences under Sections 306 and 498-A r/w. 34 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was filed on 16.09.2023 by the father of the deceased stating that his deceased daughter was married to A-1 in the year 2010. However, A-1 was harassing his daughter for additional dowry and he used to abuse her in filthy language. It is alleged that A-1 was having illegal affairs with other women. It is also alleged that these petitioners and other family members were supporting A-1.

Since these petitioners were already married and were living separately, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.5 and 6 are directed to surrender before the Station House Officer, Jangaon Police Station, Warangal on or before 16.11.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.5 and 6 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.5 shall appear before the concerned Police at 10:00 a.m. on every Monday for a period of four weeks for the purpose of investigation and thereafter, as and when required. As far as petitioner No.2/A-6 is concerned, she shall appear before the Police as and when required.

3) The petitioners/Accused Nos.5 and 6 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
