HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.12626 of 2024 ORDER :

Petitioners/accused Nos.1 and 2 have filed this petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhitha, 2023 seeking bail in Crime No.505 of 2024 of PS Mahabubnagar, registered for the offences under Sections 406, 417, 420, 467, 468, 471 and 474 r/w. 34 of IPC. 2.

Heard Sri G.Ravi Chandran, learned counsel for petitioners and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the State and perused the record. 3.

The case of the prosecution is that accused Nos.1 to 3 conspiring with each other have created fake pattas and sold the Government land to various persons. Believing their words, the de facto complainant and some others constructed houses in the said land, which were demolished by the Government. 4.

Learned counsel for petitioners submits that the petitioners/accused Nos.1 and 2 are innocent and have been falsely implicated in the case. He further submits that accused

JS, J Crl.P.No.12626 of 2024 No.3 in the said crime was already enlarged on bail. He further submits that most part of the investigation in the case is completed, and the petitioners/accused Nos.1 and 2 were in jail since 13.09.2024, and hence, prayed for grant of bail. 5.

The learned Additional Public Prosecutor opposed the application stating that specific allegations are levelled against the petitioners/accused Nos.1 and 2. He further submits that investigation is in progress and if the petitioners/accused Nos.1 and 2 are released on bail at this stage, they may tamper with the evidence and may threaten the witnesses, and hence, prayed to dismiss the petition.

Having heard both sides and perused the material on record, since major part of the investigation is completed and accused No.3 is already released on bail, this Court is of the considered view that it is a fit case for grant of bail subject to following conditions:

1. The petitioners/accused Nos.1 and 2 shall be released on bail on each of them executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of IV

2. The petitioners/accused Nos.1 and 2 shall appear before the concerned Station House Officer on every Saturday between 11.00 A.M. and 01.00 PM for a period of eight (08) weeks or till filing of charge sheet, whichever is earlier.

3. The petitioners/accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 480 (3) of Bharatiya Nagarik Suraksha Sanhitha, 2023.

Petition is allowed accordingly.
